JM Eagle is very pleased to present you with a summary of the facts concerning the recent allegations made attacking the quality of JM Eagle's PVC pipe.
These accusations are baseless and you, as our customer, deserve real truth, which you will find here. Each fact is supported by the verifiable documents with links listed on the right of this page.
Claim: The qui tam lawsuit is warranted.
FACT: The United States and key states have declined to intervene.
- After three years of investigation, review and consideration, the U.S. government chose not to intervene in the relator’s lawsuit.
- Federal statistics show 94 percent of FCA lawsuits are dismissed when the U.S. government declines
to intervene. - California, where the lawsuit was filed, and Florida have also declined to intervene.
Claim: JM Eagle manufactures pipe that does not meet standards and fails.
FACT: JM Eagle’s gross claims rate over the last 10 years is less than 0.1 percent, the majority of which are related to installation or other non-manufacturing errors.
FACT: JM Eagle pipe meets or exceeds all relevant standards.
- JM Eagle pipe has been continuously certified to AWWA standards by UL and NSF International.
- JM Eagle submits to unannounced inspections by UL and NSF.
- Tests conducted by one of North America’s leading testing firms, Jana Laboratories, confirm JM Eagle’s PVC pressure pipe meets the requirements for long-term strength.
- JM Eagle’s JM90 PVC compound has always been NSF/PPI certified.
FACT: JM Eagle products meet applicable LTS requirements.
- JM90 has always been certified by UL as having Longitudinal Tensile Strength (LTS) of 7,000 psi.
- UL has clarified that its LTS requirements apply to PVC compound, and not to pipe.
Claim: JM Eagle cuts costs by sacrificing quality.
FACT: Allegations of cost cutting by JM Eagle lack any merit.
- JM Eagle uses only ingredients approved by NSF/PPI.
- Continuous improvements in the manufacturing process allow JM Eagle to increase production without diminishing quality.
FACT: Over the last 15 years, JM Eagle has made more than $350 million in capital expenditures.
Claim: The relator can be trusted.
FACT: Both the relator and his suit have serious credibility problems.
- The complaint:
- The complaint falsely attributes statements to former plant manager Brian Wang; he has provided a sworn statement unequivocally denying the statements attributed to him by the relator.
- The complaint’s remaining allegations largely rely on unverified hearsay and irrelevant test results.
- The relator:
- Based on a sworn affidavit by a JM Eagle customer, the relator solicited kickbacks from the customer in exchange for preferential treatment of the customer’s warranty claim.
- After he was terminated for his gross misconduct, the relator falsely represented himself as a JM Eagle employee.
